These terms and conditions shall be subject to, construed under and enforced according to the laws of the State of Illinois. A judicial determination that any portion of this Agreement is unenforceable shall not affect the enforceability of the remainder of this Agreement.
Any action based upon these terms and conditions shall be instituted and litigated in the courts of Stephenson County, State of Illinois and no other. In accordance herewith, you hereby submit to the jurisdiction and venue of the courts of Stephenson County, Illinois.
In the event of a dispute between you and FHN with respect to these terms and conditions, the non-prevailing party in such a dispute shall pay all costs and expenses incurred by the prevailing party, including any reasonable attorneys' fees incurred by the prevailing party from the date the prevailing party was first made aware of the dispute.
As used in this document, the term "Web site" shall mean and refer to all computer files and portions thereof, including without limitation all executable files, text files, HTML files, scripts, images and graphics, and any other computer files which may be viewed, linked together or downloaded as a single interactive unit, and accessed by the general public using the domain name "www.fhn.org," or some derivative thereof.
